GENERAL TERMS & CONDITIONS

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of www.chennaibatterybazaar.com website.

Your use of Chennai Battery Bazaar {including www.chennaibatterybazaar.com (hereinafter referred to as "Website") and related sites, services, and tools} is governed by the following terms and conditions as applicable to the Website and the sale made through the same.

Chennai battery bazaar provides its services to you subject to the notices, terms and conditions set forth in this agreement.

Chennai Battery Bazaar is a project owned and managed by Chennai Battery Bazaar, a company with a registered office at Chennai.

By using the Site in any manner, including but not limited to visiting or browsing the Site, you (the "user" or "you") agree to be bound by this Agreement, including those additional terms and conditions, rules, policies, guidelines referenced herein and/or available by hyperlink.

This Agreement applies to all users of the Site, including without limitation users who are vendors, customers and merchants, contributors of content, information and other materials or services on the Site.

‘You’ shall also mean any natural or legal person or group of individuals who has agreed to become a member of the Website by providing Registration Data (as defined hereinafter) while registering on the Website as Registered User using the computer systems of the Website and accepted this electronic version / electronic record of the User Agreement.

Any disputes will be settled under Chennai jurisdiction only.

Contractual Terms and Conditions

 Order Processing:  

• All orders are to be placed online. Upon customer’s request, CBB executive may assist in creating an online account and guide to place an order.
• All the products displayed in the website are inclusive of GST.
• Only online payments are accepted (no Cash on Delivery will be accepted).
• After placing order and completing the payment process, an order copy will be sent to your e-mail Id & SMS to your mobile.
• The order will be processed immediately once confirmed by us.
• Upon initiation of shipment, an Invoice will be sent separately to your registered email-id & message will be sent to registered mobile number with delivery details along with a four-digit secret key (Four digit secret key should be shared only with the service partner after accepting the delivery by the customer). Any miss from Customer side will not be a responsibility of CBB under any circumstances.
• The price of the buy-back products shown in the website is for customer reference only. The actual price will be calculated and paid on-site after the inspection of the buy-back product.
• CBB phone number and e-mail address are available in the Contact Us section in the website.
• By placing an order with CBB, the customer agrees to buy the products for their own personal and/or business needs only and not for any illegal activities.

Order Delivery Timing & Process:

• CBB working hours are from 10 AM to 7 PM on Monday to Saturday (For delivery on Sunday, customers can request under the Special Instructions message box in the ordering webpage).
• Before delivery, the Service Partner will ensure the customer’s availability at site, readiness of wiring (for Inverter-Battery orders only), Installation Position (Floor & Loft on site), buy-back product details and confirm if the delivery key has been received (Delivery key should only be shared with the delivery personnel at the point of delivery). Any miss from Customer side will not be a responsibility of CBB under any circumstances.
• If the product is readily available, it will be dispatched within 12 hours.
• Express delivery is available for selected locations only.
• If there is any delay in delivery due to unforeseen circumstances, CBB will contact you to get your confirmation to execute the order with the new delivery time.

Installation:

• Upon delivery, Service Partner will install the product as required.
• The installation does not include wiring or any other additional services.
• If the customer needs wiring or any other additional services related to the installation of the product, it has to be mentioned in the Special Instructions message box while ordering the product, which will be considered and arranged at the discretion of CBB.
• The service personnel will inspect the additional services request and determine the feasibility of carrying out such services based on his/her expertise. Any unqualified requests will have to be arranged or carried-out by the customer themselves.
• Any cost or damages incurred from additional services will have to be determined and agreed between the customer and the service personnel. CBB will not have any involvement if any dispute arises.

Order Cancellation:

• If the customer wishes to cancel an order, it can be done before the shipment starts (A message will be sent to registered mobile number once shipment commences) using his/her login credentials.
• If once the shipment starts, customer will not able to cancel their order through the website.
• Order can be cancelled after shipment by sending a message to 9840853864 or an e-mail to info@chennaibatterybazaar.com along with order number.
• CBB will not be able to make any exceptions.
• CBB will refund the amount in accordance with Section “Payment Refund” in this document.

Return of Products:

• If the customer is unsatisfied with the product delivered (product not supplied as per specifications), he/she needs to e-mail CBB at info@chennaibatterybazaar.com or contact at 9840853864 within 2 days (includes installation day) from the date of receiving the product.
• The refund process for cancelled order will start only after CBB receives the cancelled and/or returned product with full packing materials and validate the return. CBB will arrange a pick-up service from the customer’s location.
• Post receipt of the returned product in its original condition including the package, CBB will inspect the same and approve. Once approved as an eligible return, CBB will issue your refund amount within 7 days in accordance with the section “Order Cancellation” in this document. If the return product is not found eligible for a refund, CBB will send the same product back to the customer.
• In either scenario, the return issue will be closed by approximately 10 days of receiving the return package from the customer.
   

Payment Refund:

CBB will refund the amount in your account within 7 working days after deducting,

• 3.5% towards cancellation charges before shipment commences
• 5% towards cancellation charges after shipment commences
• Any other costs incurred in processing the order will be added to cancellation charges.
• If the Refund is due to incorrect / damaged / defective product delivered, CBB will replace the product or reimburse the full invoice value as per customer’s choice.

Warranty Policy:

• Every product has its own warranty clause as per respective product manufacturer’s policy. CBB will not be able to make modifications to the same.
• Upon delivery, customers will receive the warranty card along with the product. CBB recommends to check the serial number mentioned in the product and warranty card are same.
• CBB recommends the customer to register their details for the product purchased on Brand or CBB website under the warranty registration.
• Warranty claims will have to be registered and settled directly by the product’s manufacturer as per their policies and Terms & Conditions.
• It is the responsibility of the customer to retain the Invoice Copy & Warranty Card throughout the warranty period.

Amendments:

CBB may amend this User Agreement and Terms & Conditions mentioned in this document at any time as it find appropriate. These amendments will be determined at Chennai Battery Bazaar's sole discretion, in good faith, and using common sense and reasonable judgment. CBB in not bound to notify Customers about these amendments.

Membership Eligibility:

Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents, etc. are not eligible to use the Website.

Registration Compliance and Your Account Obligations:

You agree to provide, maintain and update the data to keep it true, accurate, current and complete information about yourself as prompted by Chennai Battery Bazaar's registration form, profile generation, etc.

You agree to comply with all local laws regarding online conduct and acceptable content. In addition, Customer must abide by Chennai Battery Bazaar's Terms & Conditions stated in this document.

Age:

If you are a minor i.e. under the age of 18 years, you shall not register as a member of the Website and shall not sell or purchase any items on the Website. As a minor, if you wish to purchase or sell an item on the Website, your legal guardian or parents who have registered as users of the Website may make such purchase or sale. This provision is void where prohibited by law and the right to access the Site is revoked in such jurisdictions.

Password:

Keep your password secure. You are fully responsible for all activity, liability, and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify the Chennai Battery Bazaar of any unauthorized use of your password or any breach of security. You also agree that Chennai Battery Bazaar cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.

Account Transfer:

You may not transfer or sell your Chennai Battery Bazaar account and User ID to another party.

Right to Refuse Service:

Chennai Battery Bazaar's services are not available to temporarily or indefinitely suspended Chennai Battery Bazaar members. Chennai Battery Bazaar reserves the right to refuse any of its services to anyone, for any reason, at any time.

Chennai Battery Bazaar reserves the right to terminate your membership and refuse to provide you access to the Website any time at its discretion.

Electronic Communications:

When You use the Website or send emails or other data, information or communication to Chennai Battery Bazaar, You agree and understand that You are communicating with Chennai Battery Bazaar through electronic records and You consent to receive communications via electronic records from Chennai Battery Bazaar periodically and as and when required. Chennai Battery Bazaar will communicate with you by email or electronic records on the Chennai Battery Bazaar Website, which will be deemed adequate service of notice / electronic record.
